Generally the law is broken into two very broad areas, civil matters and criminal matters. Each has its own unique set of rules and law that applies to how one of these cases is handled.

What is a Civil Case?

Civil cases involve personal injury, wrongful death, divorce and alimony, custody, adoption, proceedings for adult guardianship in the probate court, suits involving negligence, property disputes, and most everything else that isn’t a criminal matter.

What is a Criminal Case

Criminal cases involve the State of Georgia or the Federal government charging a citizen with a crime. The burden is always on the government to present evidence that would convince a judge or jury of the person’s guilt beyond a reasonable doubt. Criminal cases are further divided into misdemeanors and felonies.

Difference between misdemeanor and felony criminal charges

A misdemeanor conviction, while serious, does not generally carry as harsh of a penalty as a felony conviction. Driving under the influence of alcohol / DUI, reckless driving, possession of less than 1 oz. of marijuana, a minor in possession of alcohol, and simple battery are all example of misdemeanors. Penalties for a misdemeanor can include probation, payment of fines and fees, and the loss of your driver’s license.

Crimes like aggravated assault, aggravated battery, habitual violator, violations of the Georgia Controlled Substances Act, murder, rape, and child molestation are examples of felony offenses. Penalties for felony convictions can range from probation and a fine all the way up to the death penalty in the most serious of cases.
